In 2023, Minnesota created more avenues for offenses to be automatically expunged. However, it’s important to note that automatic  expungements only occur for certain offenses. And domestic assault is not one of them. But despite domestic assault not being an offense that will be automatically expunged, there are still avenues to clear your record of your domestic assault case.

Expungement

If you have been convicted of a misdemeanor or gross misdemeanor domestic assault, you may be eligible for expungement provided that you have successfully completed probation, you have not been charged with a new crimes, and you have met the statutory required waiting period. You need to wait two years after discharge from probation for a misdemeanor offense and three years after discharge for a gross misdemeanor offense. If you have a felony conviction or received a stay of imposition on a case originally charged as a felony, it will be important for you to talk to an expungement attorney to explore your options.

Exploring other options such as a pardon

Another question that a good expungment attorney will ask you if you are trying to clear your record is why do you want your record cleared? It may seem obvious. But expungments only seal the record and do not destroy the record. And if your goal is to get rid of the record trying to restore your gun rights or for certain other reasons, an expungement may not be best your option. An expungement order does not restore your gun rights. So, you would be wasting your time and money if that was your goal. But there are other options such as a pardon that may better achieve your goal. It’s important to clarify your goals in order to enact a strategy to achieve what you want in clearing your record.
