Riding an e-bike home after drinking may seem very different from driving a car. Legally, however, the answer depends on exactly what type of vehicle you were operating. “Can you really get a DWI on an e-bike? Well, it depends.”
Minnesota law specifically excludes a qualifying electric-assisted bicycle from its general definition of a "motor vehicle." But Minnesota also has separate definitions for motorized bicycles and other motorized devices. The classification of the particular e-bike can therefore be extremely important.
If Roseville police stop you while you are riding an e-bike, do not assume that an arrest automatically means you will be convicted. The details matter—including the type of e-bike, whether it was modified, where you were riding, what police observed, and what testing was performed.
“Some people think that if you are on an e-bike, this means you are automatically safe from the law. This isn’t necessarily true.”
